    The Special Tribunal set aside decisions of the Department of Public Works and Infrastructure to appoint Kroucamp Plumbers CC as the provider of vacuum pumping septic tanks and blocked sewerage emergency tanks as unconstitutional and invalid and ordered Kroucamp Plumbers CC to repay certain payments received pursuant to these works once this amount is determined.

    In an urgent interdict application, the Special Tribunal granted an interdict to restrain the former National Lottery Commission senior manager, Mr Sanele Dlamini, from withdrawing or prejudicing his pension fund benefits held by Corporate Selection Umbrella Retirement Fund.

    SIU v Helicopter and Airplane Logistical Operations (Pty) Ltd and Others (GP07/2023):

    An application by the SIU to review and set aside the decision of the Free State Department of Health to appoint Helicopter and Airplane Logistical Operations (Pty) Ltd (HALO) and Buthelezi HEMS CC (Buthelezi) to provide aero-medocal services for emergency medical services to the Free State Provincial Government and the extension of said contract to HALO and Buthelezi granted. The Tribunal set aside the decision and ordered that both entities are to repay the monies received under the tender and contract, excluding actual, reasonable and lawful out of pocket expenses, once that amount is determined.

    SIU v Government Employees Pension Fund and Others (GP10/2024):

    The Tribunal granted an interdict preventing the Government Employees Pension Fund from processing and paying out pension benefits to Ms Matilda Matozi Gasela pending the finalisation of proceedings in the matter, with Ms Gasela also being interdicted from withdrawing her pension fund benefits administered by the City of Ekurhuleni Metropolitan Municipality.

    SIU v Buthelezi EMS (Pty) Ltd and Others (FS01/2024):

    The Tribunal set aside the appointment of Buthelezi EMS (Pty) Ltd by the Free State Department of Health and subsequently contracts for the rendering of inter-facility emergency medical services. Buthelezi EMS (Pty) Ltd and its related entities were also ordered to repay a total amount of R532 789 770.56 as well as other amounts received under these contracts once those amounts are fully determined.

    SIU v Department of Defence and Military Veterans and others (GP14/2024):

    The Tribunal set aside the resolution of the Departmental Commercial Procurement Board to award the purchase of Microsoft licences to Software One for a three year period, the subsequent acceptance letter, and all agreements entered into by the Department pursuant to this award, and declared these all to be unconstitutional, unlawful and invalid, with Software One ordered to repay all profits derived from the licences to the Department.

    SIU v Nangamso Tyibilika and Others (GP01/2025):

    Order prohibiting the Government Employees Pension Fund and the Government Pensions Administration Agency from paying out Ms Tyibilika’s pension benefits, as a result of Ms Tyibilika, who served as chief director of budget management and acting chairperson of the departmental commercial procurement board, allegedly playing a central role in the irregular awarding of personal protective equipment contracts to joint suppliers.

    Ramatsekisa v SIU and Others (GP21/2023):

    Application for the release of R1.2 million preserved in the applicant’s pension fund dismissed. The Special Tribunal held that it had judicial discretion for granting interdictory relief, including preserving pension funds and also adjusting the interdictory relief to release funds for legal and living expenses. However, as the applicant had failed to provide full and frank disclosure of his financial situation, there was simply insufficient material facts for the Tribunal to grant the relief the release of funds as sought by the applicant.

    SIU and Transnet SOC Ltd v Dynamic Power Engineering (Pty) Ltd (previously Superfecta Trading 209 (Pty) Ltd) (GP06/2022):

    The Special Tribunal ruled that the decision of the former Group Executive: Transnet Property to award contracts to Superfecta Trading 209 (now Dynamic Power Engineering) for generator installation in 2016 and maintenance services in 2017 at the Carlton Centre precinct was unconstitutional, unlawful and invalid. Both contracts have been reviewed and set aside, with settlement agreements totalling over R31.4 million signed by the SIU and Transnet and Transnet agreeing to repay R21.4 million in net profits and legal costs.
